Terms & Conditions

1. Conditions Applicable

1.1 By Placing an order with Driffield Stoves Ltd, the buyer agrees to be bound by these terms and conditions. If you do not accept these terms, Driffield Stoves Ltd reserves the right to refuse supply of goods at its discretion.

1.2 Any variation of these terms and conditions ( including any special terms and conditions agreed between the parties ) shall be inapplicable unless agreed in writing by Driffield Stoves Ltd, acting by its Managing Director or some other person authorised by him in writing.

1.3 Product and general information is offered in good faith, but should not be regarded as a guide. We recommend you confirm details before making any purchasing or contractual arrangements.

1.4 Any typographical, clerical or other error or omission in any sales literature, quotation, price list, acceptance of offer, invoice or other document or information issued by Driffield Stoves Ltd shall be subject to correction without any liability on the part of Driffield Stoves Ltd.

Your Statutory rights are not affected.

2. Price

2.1 Prices are correct on the date which the quotation is accepted.

2.2 All quotes are based on our initial inspection of the proposed location of the appliance therefore any unforeseen circumstances may lead to an extra charge. This will be discussed with the customer of the time it becomes apparent.

2.3 All prices include VAT at the standard current rate and are subject to change.

2.4 Driffield Stoves Ltd reserves the right to change any advertised prices at any time.

2.5 Delivery charges will apply to all orders, they will vary dependant on order quantity and type of product. Always check with us to confirm correct charges apply.

2.6 All prices are in Great Britain Pounds Sterling.

2.7 All quotations are valid for 30 days of the date issued and may vary due to market fluctuations.

2.8 All goods and prices are subject to availability form our suppliers.

3. Supply of goods

3.1 The Buyer is solely responsible for insuring that the Products are suitable and fit for the purpose.

3.2 Driffield Stoves Ltd reserves the right to refuse the supply of goods at its discretion.

4. Payments

4.1 All supply and installation orders require a 50% deposit to be paid prior to receiving an installation date. Outstanding balances must be paid in full within 7 days of completion upon receiving a final invoice.

4.2 All special orders must be paid in full at the time of purchase.

4.3 If you wish to make payments by cheque, please make all payments to Driffield Stoves Ltd. Please write your address on the back of the cheque for verification of the payment.

4.4 Driffield Stoves accept payment with all major credit and debit cards, including Visa, MasterCard, Delta, Switch, Maestro. No charge is made to a consumer for credit card payments.

5. Cancellation of orders & returns

5.1 The buyer has the right cancel an order purchased in store at any time before despatch or within 7 days of receiving your goods for a full refund excluding cost of return postage providing the item is fully packaged and undamaged.

5.2 Any items on special order including spare parts and fireplaces are non returnable and non refundable. Wood Burning and Multi Fuel Stoves , Electric and Gas Fires will incur a 25% restocking charge which will be deducted from the final refund. Only stock items are returnable without charge within 30 days of purchase subject to condition. This does not affect your Statutory as a consumer.

5.3 We normally pay refunds on cancellations or when goods have been returned safely within 7 days under the Consumer Contracts Regulations 2014.

5.4 The returned goods must not have been fitted, installed or used in any way. The cost of returning the item is your responsibility. You are advised to keep the goods in their original packing otherwise you will find it difficult to return the item.

6. If goods are faulty or damaged

6.1 Please examine all goods on delivery in case any damage has occurred in transit. The driver should be notified immediately of any problems and the ticket should be signed accordingly.

6.2 We can not guarantee to replace or repair items which have been signed for in good condition or 'unchecked' and are later found to be damaged. This does not affect your statutory rights.

6.3 Driffield Stoves Ltd will not accept any liability for any Products that have been repaired before we have been given the opportunity to inspect them or to give authority for repair work to be carried out or in cases where non Company components have been used.

6.4 All items must be returned in their original packaging to prevent further damage.

6.5 If goods have been delivered in a damaged state and we feel the situation can not be improved by authorising another delivery, we reserve the right to refund you in full for your order and cancel the order.

7. Title and Risk

7.1 Risk of damage to or loss of the Products shall pass to the Buyer upon delivery.

7.2 Not withstanding any other provision herein title in the Products shall not pass to the Buyer until Driffield stoves Ltd has received in cash or clear funds payment in full.

8. Privacy and Security

8.1 All personal details that you give us are securely stored. We do not supply or sell customers details to any outside organisation. We will endeavour to take all reasonable care, in so far as it is possible to do so, to keep all details of your order and payment secure, but, in the absence of negligence on our part we cannot be held liable for any loss you may suffer if a third party procures unauthorised access to any data you provide when accessing or ordering.

9. Installation Services

9.1 All chimneys must be swept prior to installation by a registered Chimney Sweep. This does not guarantee complete removal of soot and debris from your chimney and therefore we can not be held accountable for your carpets or furniture for any soot damage or dust left behind after the installation.

9.2 All furniture and carpets must be removed from the room where the new appliance is to be installed prior to installation, any remaining items will be left at the owners risk. However we endeavour to cover any remaining items to minimise potential damage.

10. Installation Satisfaction

10.1 Upon completion of the installation, the consumer will be asked to sign a Job Satisfactory Note . This states that you are satisfied with the services you have received, all the products are in satisfactory condition and full working order and that you are happy with the condition your property has been left.

11. Warranty and Liabilities

11.1 All goods supplied by Driffield Stoves Ltd come with a manufacturer's warranty of at least 12 months.

11.2 Driffield Stoves Ltd shall provide the Buyer with such information as is required to claim under the manufacturer's warranties. In the event of a claim, the Buyer shall in the first instance contact Driffield Stoves Ltd customer service department.

11.3 Driffield Stoves Ltd does not provide any warranty cover against defects in his own right.

12. Costs Incurred by you

12.1 We are not liable for any costs incurred by you or any loss of earnings as a result of a late delivery or delayed installation due to unforeseen circumstances.

13. Pictures and Images

13.1 All sizes and measurements of products on our website and brochures are approximate and supplied to us by the manufactures, therefore Driffield Stoves Ltd and any of their employees cannot accept liability for errors or omissions. We provide every effort to supply accurate information, however specifications may change without notice. Please confirm any specifications before ordering.

13.2 All pictures on our website are for illustrative purposes only and may not exactly match the product itself. Colours may vary to those products illustrated and can look different on alternative computer screens. Driffield Stoves Ltd would never knowingly publish misleading or incorrect product descriptions or imagery.

14. General

14.1 Neither party shall be liable for any delay or failure to perform any of its obligations if the delay or failure results from events or circumstances outside its reasonable control and the party shall be entitled to a reasonable extension of its obligations.

14.2 It is your responsibility to ensure that products that are not installed by Driffield Stoves Ltd are installed correctly and in compliance with current building regulations. Contact the Building Control Officer of your Local Authority to find which regulations apply to you.

14.3 These terms and conditions are subject to change at any time without prior notice to you.
